I. Minutes: Regular Council Meeting of August 28,  2017.

II. Old Business

A. (080217-2) The Town of Houlton ordains that Chapter 6, Cemeteries, of the Houlton Code, be amended as follows:  Sec. 6-102 Definitions; Sec. 6-106 Sale of Lots; Sec. 6-107 Care of Cemetery; Sec. 6-108 Regulations for Improving Lots. … (old words lined through, new words underlined)

4. Plantings.  Lawns shall not be obstructed by any plantings or decoration except in the following manner:

a. Planting of flowers must be made in front of the above ground monument only.  Such plantings shall not exceed 14 inches in width and cannot exceed beyond the base of the monument.

4 5.  Grave Markers.  Only one (1) upright monument shall be permitted on a lot which must be located in the center of the lot.  No monument shall exceed a base size from end to end of sixty (60) percent of the width of the lot. All headstones markers, and monuments shall have a cement poured foundation of not less than four (4) feet in depth.  Grave markers shall be set flush with the ground. …

A. (090117-1) Council approves execution of the application to the Department of Public Safety by Chester L. Briggs d/b/a American Legion Post 47, 184 Bangor Street, for renewal of their liquor license.

B. (090117-2) The Town of Houlton ordains that Chapter 7 General Assistance Appendix A, C, and D dated October 1, 2016 to September 30, 2017 of the Houlton Code be replaced with General Assistance Appendix A, C, and D dated October 1, 2017 to September 30, 2018. (Introduction)

C. (080117-3) Council accepts the additional grant award of $40,825 from the Federal Emergency Management Agency (FEMA) Fiscal Year 2016 Assistance to Firefighters Grant (Award No. EMW-2016-FV-01030) for the purchase of a Pumper/Engine for the Fire Department and authorizes the Town Manager to sign all documents pertaining to said award.  (Note:  The total grant award is $374,159, total Town’s share is $18,708)

D. (080117-4) Council reconsiders their vote taken on the following adopted ordinance: the Town of Houlton repeals Article V General and Supplementary Regulations, Sec. 42 Recreational Marijuana Commercial Facilities of the Houlton Zoning Ordinance, adopted by Town Council February 21, 2017 and replaces it with Article V General and Supplementary Regulations, Sec. 42 Recreational Marijuana Ordinance dated June 1, 2017, adopted by Town Council July 24, 2017.

E. (080117-5) Council adopts the following ordinance proposed through the initiative petition process:  An Ordinance to Prohibit Retail Marijuana in Houlton.  The Town of Houlton ordains that the Ordinance passed on July 24, 2017 and entitled “Replacing Recreational Marijuana Commercial Facilities Ordinance That Was Adopted February 21, 2017” is hereby amended by repealing all text after the Purpose and Authority clause and replacing it with the following text:

C.  The licensing of Retail Marijuana Establishments in the Town is prohibited.

D. The operation of Retail Marijuana Establishments or Retail Marijuana Social Clubs in the Town is prohibited.

E. The cultivation, manufacture, distribution, testing and sale of Cannabis in the Town is prohibited, except this prohibition shall not affect Authorized Conduct pursuant to Title 22 MRSA Chapter 558 C (Maine Medical Use of Marijuana Act).
